1. Agreement to Terms

By accessing and using EdDriving ("Service," "Platform," "we," "us," or "our"), you ("User," "Driving School," "Organization") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

EdDriving is a compliance-first driving school management platform designed to help driving schools manage student enrollments, certifications, scheduling, and maintain regulatory compliance.

2. Description of Service

EdDriving provides driving schools with:

  • Student enrollment and progress tracking
  • Compliance enforcement for certification requirements
  • Certificate approval workflows with audit trails
  • Document management and viewing tracking
  • Scheduling and booking management
  • Payment processing and billing management
  • Communication tools (email notifications, reminders)
  • Reporting and analytics

3. Eligibility

You must be at least 18 years old and have the authority to enter into these Terms on behalf of your organization to use the Service. By using EdDriving, you represent and warrant that you meet these eligibility requirements.

4. Account Registration and Security

4.1 Account Creation: You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized access to or use of your account.

4.3 Multiple User Accounts: Organizations may create multiple user accounts (administrators, instructors, students). The organization is responsible for all activities of its users.

5. Subscription and Fees

5.1 Subscription Plans: EdDriving offers subscription plans with varying features and pricing. Current pricing is available on our pricing page.

5.2 Payment: Subscription fees are billed in advance on a monthly or annual basis. You agree to pay all fees associated with your selected plan.

5.3 Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

5.4 Refund Policy: Subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy.

5.5 Payment Processing: Payments are processed through third-party payment processors (Stripe). By using the Service, you agree to the terms and privacy policies of these payment processors.

6. Compliance and Legal Responsibility

6.1 Compliance Assistance: EdDriving is designed to help driving schools maintain compliance with state and federal regulations. However, the ultimate responsibility for legal compliance rests with your organization.

6.2 Not Legal Advice: EdDriving does not provide legal advice. While we implement compliance features based on our research of driving school regulations, you are responsible for ensuring your operations comply with all applicable laws.

6.3 State-Specific Requirements: You are responsible for understanding and complying with your state's specific requirements for driving school operations, certification, and record-keeping.

6.4 Verification Responsibility: Administrators are responsible for verifying student requirements before approving certificates, even though EdDriving provides enforcement mechanisms to prevent invalid approvals.

7. User Conduct and Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to bypass compliance enforcement mechanisms
  • Access or attempt to access accounts, systems, or networks not authorized to you
  • Interfere with or disrupt the Service or servers/networks connected to the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Upload malicious code, viruses, or any code designed to harm the Service
  • Impersonate any person or entity or misrepresent your affiliation
  • Collect or store personal information about other users without consent
  • Resell or redistribute the Service without written permission

8. Data Ownership and Privacy

8.1 Your Data: You retain all rights to the data you input into EdDriving (student information, course data, etc.). EdDriving claims no ownership rights over your data.

8.2 License to Use Your Data: You grant EdDriving a limited license to use your data solely to provide the Service, including storing, processing, and displaying your data as necessary to operate the platform.

8.3 Privacy: Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8.4 Data Security: We implement reasonable security measures to protect your data. However, no system is completely secure, and we cannot guarantee absolute security.

8.5 Data Retention: Upon termination of your account, we will retain your data for a period consistent with legal requirements and our data retention policies (typically 7 years for compliance purposes).

9. Educational Records Compliance

9.1 FERPA Compliance: If your organization is subject to the Family Educational Rights and Privacy Act (FERPA), you are responsible for ensuring your use of EdDriving complies with FERPA requirements.

9.2 Minor Student Data: If you collect data from students under 18, you are responsible for obtaining appropriate parental consent and complying with applicable laws including COPPA (Children's Online Privacy Protection Act).

9.3 Records Access: You are responsible for responding to requests from students or parents for access to educational records stored in EdDriving.

10. Intellectual Property

10.1 EdDriving IP: The Service, including all software, designs, text, graphics, logos, and other content, is owned by EdDriving and is protected by copyright, trademark, and other intellectual property laws.

10.2 Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes, subject to these Terms.

10.3 Restrictions: You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code.

11. Third-Party Services

EdDriving integrates with third-party services (payment processors, email services, etc.). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the actions or policies of third-party service providers.

12. Service Availability and Modifications

12.1 Availability: We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control.

12.2 Modifications: We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We will make reasonable efforts to notify you of significant changes.

12.3 Updates: We may update the Service software periodically. Some updates may be mandatory to continue using the Service.

13. Termination

13.1 Termination by You: You may terminate your account at any time by cancelling your subscription through the Service or contacting support.

13.2 Termination by Us: We may suspend or terminate your account if you violate these Terms, fail to pay fees, or for any other reason with notice when practical.

13.3 Effect of Termination: Upon termination, your right to access and use the Service ceases immediately. We will provide reasonable opportunity to export your data before permanent deletion.

14. Disclaimers and Limitation of Liability

14.1 AS-IS Basis: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

14.2 No Compliance Guarantee: WHILE EDDRIVING IS DESIGNED TO ASSIST WITH COMPLIANCE, WE DO NOT WARRANT THAT USE OF THE SERVICE WILL ENSURE COMPLIANCE WITH ALL APPLICABLE LAWS AND REGULATIONS.

14.3 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDDRIVING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

14.4 Maximum Liability: IN NO EVENT SHALL EDDRIVING'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT PAID BY YOU TO EDDRIVING IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

15. Indemnification

You agree to indemnify, defend, and hold harmless EdDriving and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another.

16. Governing Law and Dispute Resolution

16.1 Governing Law: These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of law provisions.

16.2 Arbitration: Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court to prevent infringement of intellectual property rights.

16.3 Class Action Waiver: You agree to resolve disputes with EdDriving on an individual basis and waive the right to participate in any class action or representative proceeding.

17. General Provisions

17.1 Entire Agreement: These Terms, together with the Privacy Policy and any other legal notices published by EdDriving, constitute the entire agreement between you and EdDriving.

17.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

17.3 Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

17.4 Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

17.5 Force Majeure: EdDriving shall not be liable for any failure to perform due to circumstances beyond its reasonable control.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
